United States District Judge Theodore Chuang issued a ruling on March 19th, 2025, stating that Elon Musk and the Department of Government Efficiency (DOGE) likely “violated the United States Constitution in multiple ways, and that these actions harmed not only Plaintiffs, but also the public interest, because they deprived the public’s elected representatives in Congress of their constitutional authority to decide whether, when, and how to close down an agency created by Congress.”
This ruling, which relied on the Appointments Clause, U.S. Const. art. II, § 2, cl. 2, and of the constitutional principle of the Separation of Powers, includes a preliminary injunction that provided the Plaintiffs with a certain degree of protection for the time being.
Will the Republican majority in Congress provide pushback to the Executive Branch’s overreach?
